Mechanic's Liens

Another important surety device is called a "Mechanic's Lien". This is a lien, usually made by the material supplier, which gives statutory authorization for that supplier to remove his product should he fail to be paid by a contractor or subcontractor for his merchandise.

Such liens - sometimes called construction liens - can also be levied by a subcontractor upon the general contractor, should the general contractor fail to pay a subcontractor for services rendered. In this case, the lien can, under certain circumstances, give the subcontractor the legal right to remove from the building any materials purchased for which no obligated payment has been made.
