As I am sure many of you have heard, there are various lawsuits being filed against Endoscopy Center of Southern Nevada.  The clinic was apparently reusing syringes and other equipment to “save money.”  Now there are six confirmed cases of Hepatitis C and the roughly 40,000 people who were treated at the clinic in the last several years have possibly been exposed to Hepatitis C, Hepatitis B, and/or HIV. 

People are being urged to be tested.  This will likely be the largest class action med mal case in Nevada history.  We have had a couple of calls.  If you know of anyone affected, Susan and/or I would be happy to talk to them.  What we are doing now is signing a contingency agreement with them and urging them to go be tested.   Susan will follow up with them and give them information.  We will be doing a flat 30% fee.

The first action in this was filed last Thursday, on the day the news story broke.  If it is certified as a class, then we will join the class with our Plaintiffs.  In the end, this will boil down to two sets of litigants—those who actually contract a disease and those who were forced to live with the fear of contracting a disease (as well as the costs and inconvenience of continual testing).  Their partners should also be tested and could also be a client since Hep B and HIV can be spread through sexual contact.

A Plaintiff’s attorney wrote the following as a comment to the fleecing that was perpetrated against the citizens of Nevada when they were duped (by the spending of in excess of $10 million in advertising by the insurance companies) into voting for the KODIN legislation in 2004:  (Remember the TV ads?...the poor doctor had his suitcase in his hand and appeared to be heading out of town on the side of the freeway….the caption was, “our doctors are leaving Nevada”)

Not long ago an organization named "Keep Our Doctors in Nevada" pressured the Nevada Legislature into an emergency session and persuaded the Nevada citizens to vote for medical malpractice protection, all in the name of a phony "medical malpractice crisis." Dr. Dipak Desai and the Endoscopy Center of Southern Nevada were behind the Keep Our Doctors in Nevada group, shelling out at least $25,000 to buy protection from injured patients. As a result, medical providers, INCLUDING DR. DESAI AND HIS CLINIC, are protected by caps on damage awards. Does anyone now think $350,000 is adequate compensation for the pain and suffering that will be endured by any patient of Dr. Desai who contracts HIV/AIDS, Hepatitis B, or Hepatitis C?

Like many lawyers who represent injured medical patients, our law firm, Myers & Gomel, fought against the caps, and I can tell you this is precisely the type of situation we were concerned about when the doctors and their insurance companies used the "Keep Our Doctors in Nevada" fear campaign to achieve their selfish goal of protective caps. The truth is we shouldn't keep doctors like Dr. Desai in Nevada, and doctors like Dr. Desai don't deserve protective caps so they can practice sub-standard medicine with no fear of a jury's verdict.

This is a real "medical malpractice crisis," and it will not be the last one unless and until doctors like Dr. Desai can be held accountable in full for the pain and suffering caused by such blatant and irresponsible malpractice. Nevada voters should demand that the doctors' special shield laws be repealed and that they be treated like the rest of us.

Congratulations to managing partner Mark Albright for being selected by the Federal Bench to provide the keynote speech to the new federal bar admittees on December 7, 2007. A copy of his remarks will be posted here shortly. He was assigned to address the need for increased civility and professionalism among attorneys.

Congratulations to Tony May for Being Approved Today as One of Nevada’s Newest Bar Examiners!!

Tony will have the wonderful assignment from the Nevada State Bar to grade certain portions of the February and July bar exam (essays) every year! The assignment was approved by the Board of Bar Examiners!! Now we will know where he is and what he’s doing when he can’t be found around here-- reading about 150 essay answers every six months!
