David has assisted clients with intestate probate where there was no will left and when the decedent passed on their property to their family and friends in a testate probate (through a will). He has assisted clients in summary administration where the value of the probate estate was less then $75,000 or the family member had been passed on for 2 years or more and in a formal administration which is the other primary type of probate. Additional he taught a Florida Probate and Estate Planning class for paralegals at Broward Community College.    
 
Documents that are typically used in planning an estate include revocable trusts to allow the clients to maintain control over the property and provide how they would like to distribute while also providing a way to avoid probate upon death and avoid guardianship if they become incapacitated. Successor trustees would be named in either event and ensure that the property is distributed as the client wants it to be. They can also be used to provide that children or other beneficiaries receive the property at certain ages or under specific conditions to provide some asset protection for people other then the grantor who is putting the property in trust and help achieve marital deduction tax planning.
 
When a trust is used then a pour over will is also used. This pours the property remaining in the sole name of the decedent if any into the trust. Although there should not be any property remaining in this situation but it provides assurance that if there is any additional property it will pass according to the desires of the client. With both a pour over will and a regular will which designates the beneficiaries a personal representative is named. This is the person who will be in charge of gathering the assets, filing any tax returns or hiring someone to do so, if needed hiring a probate attorney, reviewing and paying claims against the estate and distributing property to the beneficiaries.
 
In addition to Estate Planning Legal advice the firm helps clients with Elder Law and Disability Planning issues in preparing Living Wills, Powers of Attorneys and Health Care Surrogate documents to ensure the individual clients wishes are maintained.   There have been recent examples of fights within the family and wishes of the disabled person not being carried out for extended number of years when these documents have not been prepared and in writing. The Florida government has even sought to act when it was contrary to what a judge found to be clear and convincing intent of the person who was disabled and was suffering from a persistent vegatative state where she had no quality of life for about 15 years with no medical probability of ever recovering. In this situation the woman was just 26 years old when her problems arose. This further illustrated that disabilities could come up at any time whether people are in their  20s, 40s, 70s or at any age and it is best to just prepare in advance and allow for peace of mind that if the worst happens your wishes will be known.
